TERMS & CONDITIONS
Welcome to Misri By Meghna Nayyar (“MISRI”, “Firm”, “we”, “our”, or
“us”).
MISRI BY MEGHNA NAYYAR is a fashion and apparel
proprietorship/partnership firm engaged in the business of designing,
manufacturing, marketing, retailing, and supplying ethnic wear, couture
garments, accessories, and related products through its website, social
media platforms, and other online/offline channels.
These Terms & Conditions govern the access, browsing, use, purchase,
and transactions conducted through the website and services offered by
the Firm.
By accessing the website and/or placing an order with MISRI, the
customer (“User”, “You”, or “Customer”) acknowledges that they have
read, understood, and agreed to be legally bound by these Terms &
Conditions.
If you do not agree with any part of these Terms, you are advised not to
access the website or purchase any product from MISRI.
1. GENERAL TERMS
1.1 All products displayed on the website are subject to availability.
1.2 The Firm reserves the absolute right to accept, refuse, cancel, or limit
any order placed on the website without assigning any reason
whatsoever.
1.3 Prices, product descriptions, promotional offers, availability, policies,
and specifications are subject to change without prior notice.
1.4 The Firm reserves the right to discontinue any product or service at
any time.
1.5 The User agrees not to misuse the website or engage in any unlawful,
fraudulent, abusive, or prohibited activity.
2. MADE-TO-ORDER & CUSTOMIZED PRODUCTS
2.1 MISRI primarily deals in handcrafted, made-to-order, designer, and
customized garments.
2.2 Due to the handcrafted nature of products, slight variations in
embroidery, colour tone, print placement, fabric texture, embellishments,
stitching, and finishing shall be considered natural characteristics of
artisanal products and shall not be treated as defects.
2.3 Customized, altered, personalized, or specially commissioned
products shall not be eligible for cancellation, return, refund, or
exchange under any circumstances.
2.4 Additional charges may apply for custom sizing, plus sizes, sleeve
additions, length alterations, urgent orders, design modifications, or
special requests.
2.5 The Firm reserves the right to accept or reject customization requests
at its sole discretion.
3. ORDER CONFIRMATION
3.1 An order shall be deemed confirmed only upon successful receipt of
payment and/or advance payment and confirmation issued by the Firm
through email, WhatsApp, SMS, call, or any other communication mode.
3.2 The Firm reserves the right to seek additional details or verification
before processing any order.
3.3 The Customer shall be solely responsible for ensuring the accuracy of
measurements, delivery address, billing information, email address,
phone number, and product specifications selected at the time of placing
the order.
3.4 MISRI shall not be liable for errors arising due to incorrect
information provided by the Customer.
4. PRICING & PAYMENT
4.1 All prices displayed on the website are in Indian Rupees (INR) unless
otherwise specified.
4.2 Applicable taxes shall be charged in accordance with prevailing laws
in India.
4.3 The Firm reserves the right to modify pricing without prior notice.
4.4 International orders may attract customs duty, VAT, import duty,
clearance charges, or local taxes imposed by the destination country,
which shall be borne solely by the Customer.
4.5 MISRI shall not be responsible for delays caused due to customs
clearance procedures or governmental restrictions.
5. SHIPPING & DELIVERY
5.1 Delivery timelines mentioned on the website are approximate and
indicative in nature.
5.2 Delays caused due to courier issues, customs clearance, weather
conditions, political disturbances, transport disruptions, strikes,
pandemics, force majeure events, or circumstances beyond the
reasonable control of the Firm shall not constitute grounds for
cancellation, compensation, refund, or damages.
5.3 Risk and ownership in the product shall pass to the Customer upon
dispatch from the Firm’s dispatch facility.
5.4 The Customer shall bear all additional shipping, holding, re-delivery,
customs, or return logistics charges, if any.
5.5 MISRI shall not be liable for non-delivery arising due to incorrect
shipping details provided by the Customer.
6. CASH ON DELIVERY (COD)
6.1 The Firm reserves the right to require partial or full advance payment
for COD orders.
6.2 In the event a COD order is refused, abandoned, cancelled, or
remains undelivered due to customer non-cooperation, the advance
amount paid shall stand forfeited and the Firm reserves the right to
refuse future COD orders from such Customer.
6.3 Any request for re-dispatch shall be subject to additional shipping
and handling charges.
7. CANCELLATION POLICY
7.1 Since most products are handcrafted and made-to-order, orders once
placed shall ordinarily not be cancelled.
7.2 Any cancellation or modification request shall be considered solely at
the discretion of the Firm and only if the production process has not
commenced.
7.3 Approved cancellations, if any, may be converted into store credit or
credit note at the sole discretion of MISRI.
7.4 Store credits/credit notes shall be non-refundable, non-transferable,
non-encashable, and subject to validity as prescribed by the Firm.
8. RETURN, EXCHANGE & REFUND POLICY
8.1 MISRI follows a strict NO RETURN and NO REFUND policy.
8.2 Exchange or replacement requests shall only be entertained where a
materially damaged product has been delivered or an incorrect product
has been dispatched by the Firm.
8.3 Any such claim must be raised within 48 hours of delivery along with
unboxing video, photographs of the product, invoice details, and original
packaging evidence.
8.4 The Firm reserves the right to independently inspect and determine
the genuineness of the claim.
8.5 Products which are worn, used, altered, washed, stained, perfumed,
damaged, or without original tags/packaging shall not qualify for
exchange or replacement.
9. ALTERATION POLICY
9.1 Any alteration assistance provided by MISRI shall be purely
discretionary and subject to feasibility.
9.2 Alteration requests beyond the prescribed period may be chargeable.
9.3 The Firm shall not be responsible for fitting issues arising due to
incorrect measurements shared by the Customer.
10. PRODUCT REPRESENTATION & COLOUR DISCLAIMER
10.1 The Firm makes reasonable efforts to accurately display product
colours, textures, and details.
10.2 However, actual colours may vary due to lighting, photography,
monitor settings, screen resolution, dye variations, and fabric
characteristics.
10.3 Such variations shall not be treated as defects or grounds for
refund/exchange.
11. INTELLECTUAL PROPERTY RIGHTS
11.1 All content available on the website including logos, brand names,
product designs, photographs, videos, graphics, text, layouts, creative
content, and marketing material shall remain the exclusive intellectual
property of MISRI.
11.2 No person shall copy, reproduce, modify, publish, distribute,
commercially exploit, or use any content without prior written consent of
the Firm.
11.3 Any unauthorized use shall invite appropriate civil and/or criminal
proceedings under applicable laws.
12. LIMITATION OF LIABILITY
12.1 The Firm shall not be liable for any indirect, incidental,
consequential, special, punitive, or economic losses arising out of use of
the website, delay in delivery, third-party courier issues, product
dissatisfaction, technical interruptions, or force majeure events.
12.2 The maximum liability of the Firm, under any circumstance, shall
not exceed the value of the product purchased by the Customer.
13. FORCE MAJEURE
The Firm shall not be liable for failure or delay in performance caused
due to events beyond its reasonable control including but not limited to
natural calamities, pandemics, governmental restrictions, transport
disruptions, strikes, cyber attacks, supplier failures, power outages, war,
riots, or acts of God.
14. PRIVACY & COMMUNICATION
14.1 By using the website, the Customer consents to receive
communications from MISRI through calls, SMS, WhatsApp, email, or
other electronic modes.
14.2 Customer information shall be dealt with in accordance with the
Firm’s Privacy Policy and applicable laws.
15. GOVERNING LAW & JURISDICTION
15.1 These Terms & Conditions shall be governed by and construed in
accordance with the laws of India.
15.2 Any dispute arising out of or relating to these Terms shall be
subject to the exclusive jurisdiction of competent courts at New Delhi,
India.
16. SEVERABILITY
If any provision of these Terms is held invalid or unenforceable by a
court of competent jurisdiction, the remaining provisions shall continue
to remain valid and enforceable.
17. MODIFICATION OF TERMS
The Firm reserves the right to amend, modify, update, or revise these
Terms & Conditions at any time without prior notice. Continued use of
the website shall constitute acceptance of such revised Terms.
